1. Definitions
"Buyer" means an entity that creates or publishes tenders. "Supplier" means an entity that submits offers or proposals. "Tender" means a procurement request published on the Platform. "Offer" means any bid, price, document, or proposal submitted by a Supplier.
"Content" includes all information, files, documents, texts, images, and data provided by users. "Account" means a registered user profile on Moberca.
2. Scope of Service
Moberca provides tools to create, manage, publish, and participate in digital tender processes, including role-based access, submission management, and structured tender workflows.
Moberca does not provide legal, financial, or procurement consultancy. Any decisions made based on the Platform are solely the responsibility of the Buyer and Supplier.
3. Account Registration & Eligibility
You must provide accurate, current, and complete information when creating an Account and keep such information updated. You are responsible for all activity conducted through your Account.
You must ensure that your Account credentials are kept confidential. If you suspect unauthorized access, you must promptly notify us and take immediate steps to secure your Account.
4. User Responsibilities
Buyers are responsible for publishing accurate, lawful, and complete tender information. Suppliers are responsible for submitting accurate, truthful, and compliant Offers, including any supporting documents.
You agree not to use the Platform for unlawful, deceptive, fraudulent, or anti-competitive behavior, including misrepresentation, manipulation of bids, or attempts to access data without authorization.
5. Tender Rules & Fair Competition
Tender deadlines, submission rules, and evaluation criteria may be defined by Buyers. Suppliers must comply with the stated requirements. Moberca may enforce submission deadlines through automated mechanisms to preserve fairness.
Moberca does not validate the commercial fairness of each Tender. Buyers and Suppliers remain solely responsible for compliance with applicable competition, procurement, and commercial laws.
6. Confidentiality
Users may share sensitive business information through tenders and offers. You agree to treat all non-public information obtained via the Platform as confidential and to use it only for lawful tender participation purposes.
Moberca provides access controls to restrict visibility; however, you are responsible for ensuring you do not disclose confidential information to unauthorized parties.
7. Intellectual Property
The Platform, including its software, interface, design, logos, and underlying technology, is owned by Moberca or its licensors and is protected by intellectual property laws.
You retain ownership of your Content. By submitting Content, you grant Moberca a limited, non-exclusive right to host, process, transmit, and display such Content solely to operate and improve the Platform.
8. Data Processing & Privacy
Moberca processes data to provide the Service, maintain security, prevent abuse, and improve platform performance. We do not sell user data or share it with third parties for marketing purposes.

9. Platform Availability & Maintenance
Moberca aims to provide reliable access to the Platform. Maintenance, updates, and improvements may be performed periodically and may result in temporary interruptions.
Moberca is not liable for any service interruptions, delays, or unavailability caused by factors beyond reasonable control, including internet outages, third-party services, or force majeure events.
10. Limitation of Liability
To the maximum extent permitted by law, Moberca shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, revenue, business opportunities, or data, arising from or related to your use of the Platform.
Moberca is not responsible for the accuracy of user-submitted Content, the outcome of tender decisions, or any disputes, agreements, or transactions between Buyers and Suppliers.
11. Suspension & Termination
Moberca may suspend or terminate access to the Platform if we reasonably believe an Account is involved in misuse, fraud, unauthorized access attempts, security threats, or violations of these Terms.

- Unauthorized access or attempts to access restricted data
- Disruption of platform operations, abuse, or malicious activity
- Violation of applicable laws or third-party rights
- Repeated policy violations or serious breach of these Terms
12. Changes to These Terms
Moberca may update these Terms to reflect platform changes, regulatory requirements, or operational improvements. Continued use of the Platform after updates indicates acceptance of the revised Terms.
If material changes are made, Moberca may provide notice through the Platform or other appropriate channels where required.
